Katherine Gordon Maynard co-presented Recent Changes Impacting State Court Practice: 2011 Tort Reform and Civil Discovery Rules Amendments at a CLE event sponsored in conjunction with the Mecklenburg County Bar (MCB) Civil Litigation Section.
A number of recent legislative initiatives have immediate relevance to practice in North Carolina state courts. As of October 1, significant changes to the civil discovery rules impact the discovery of electronically stored information and mandate the production of privilege logs in state court. Later this year, new rules regarding out-of-state discovery become effective. This CLE will cover these new rules, as well as address 2011 tort reform, including a discussion on the theory, practical considerations and possible consequences of recent revisions to the attorneys fee statute (N.C.G.S. § 6-21.1) and standard for admissibility of expert testimony (Rule 702(a)); as well as a brief introduction to the new rule of evidence on medical expenses (Rule 414) and the Trespasser Responsibility Act. These changes and additions will be effective October 1, 2011, and will apply to all actions commenced on or after that date.
